General Terms

1. This user agreement (“Agreement”)forms a binding agreement between Anvayins Travels Private Limited (“Anvayins”), its affiliates, and you (“You”/ “User”).
2. This Agreement governs Your use of Anvayins’ (and its affiliates’) website and/or mobile application and all services and products, whether or not purchased or utilised by You. You are deemed to have read, understood and expressly accepted the terms and conditions of this Agreement. If you do not agree to the terms and conditions herein, please do not visit or use the site of Anvayins and/or its affiliates.

Both You/User and Anvayins are individually referred as “Party” to the Agreement and collective referred to as “Parties”. Any reference to service or products may be used synonymously and such reference may be accordingly interpreted.

3. This policy is effective as of August 19,2019. Any material changes shall be stated in future versions of this Agreement.
4. Any contract to provide any service under this Agreement by Anvayins and or its affiliates is not complete until complete consideration towards the product and/or service is received by Anvayins or its affiliates (as the case may be) from You.
5. In the event that any of the terms, conditions, and notices contained herein conflict with any additional terms, then the terms provided therein shall prevail unless provided to the contrary. Additionally, Anvayins and its affiliates reserves the right to alter / revise any or all of the contents herein without giving prior notice to You. You agree to be responsible to monitor Anvayins’s website or other mediums for any such change.
6. Anvayins and its affiliates reserve the right, in their sole discretion, to terminate the access to the websites and/or other mediums at any time, without notice to You, for general maintenance or for any reason whatsoever.
7. Neither Anvayins nor its affiliates nor agents shall not be responsible for confirming transactions including whether the transactions are legal and valid as per the applicable laws.
8. Anvayins and/or its affiliates, at their sole discretion reserve the right to not to accept Your request without assigning any reason thereof.

Undertaking from You: You hereby undertake as follows

9. You agree that You can enter into a legally binding contract as stipulated under the Indian Contract Act, 1872.
10. You expressly undertake to provide to Anvayins and/or its affiliates, where applicable, information which is true, accurate and valid, and acknowledge that any default or deficiency would inter alia render the provision of the product or services by Anvayins and/or its affiliates, inapplicable.
11. You shall be responsible for ensuring compliance with the terms and any other rules of Anvayins and/or its affiliates including the terms governing the service fees, or other rules. If You do not agree with any part of such terms, You must not avail of any of the services.

Your use of Information

12. You may only use the site and mediums of Anvayins and its affiliates only for legitimate purposes and not for any interalia fraudulent or speculative reservations.
13. You are restrained from altering, duplicating, distributing, transmitting, reproducing, publishing, licensing or selling any information, products or services acquired from Anvayins or its affiliates through any means.
14. Anvayins and / or its affiliates may provide You access to photographs, graphics, video or other material which may be protected by intellectual property laws. You shall not copy, modify, transmit or create derivative works of such material. You also agree to not copy, modify, transmit or create derivative works of any of the intellectual property registered by Anvayins and/or its affiliates.
15. You understand and acknowledge that any material obtained by You or your permitted assigns in relation to the service of Anvayins and/or its affiliates shall be entirely at Your risk and discretion. You are solely responsible for any damage to Your computer systems or loss of data that results from the download of such material.
16. Any views, recommendations or guidance offered by any official including travel consultant of Anvayins are based out of personal knowledge of the official and You are advised to conduct your own diligence before accepting, following or adopting any of them.

Confidentiality

17. You shall maintain confidentiality in relation to all information and agree to not disclose the same unless required by law.

Termination

18. Anvayins and/or its affiliates may terminate this Agreement at any time for any reason, including any improper use of their site, products or services. Such termination shall not affect any rights of relief that may be enjoyed by Anvayins and /or its affiliates and its third party providers. Upon termination of this Agreement, all rights granted to You shall terminate.

Information obtained by Anvayins and its affiliates

19. You agree and acknowledge that information provided by You to Anvayins and its affiliates over the internet is not encrypted and that Anvayins and its affiliates do not guarantee secure data transmission over the internet. Data transmission by You is and shall be at your own risk. Further, Anvayins and its affiliates cannot guarantee against, and will not be liable for, disclosure due to errors in transmission or unauthorized acts of third parties.
20. Your use of any information or materials on the website or any other mediums of Anvayins or its affiliates is entirely at your risk, for which neither Anvayins nor any of its affiliates shall be liable to You, your agents or your permitted assigns. You are responsible to ensure the veracity of products, services and/or information provided and accessed by You on Anvayins’s and its affiliates’ website.
21. While purchasing any service or products through Anvayins and/or its affiliates, You shall provide Anvayins and / or its affiliates with personal information including Your credit card number and expiration date, credit card billing address, telephone number, e-mail address. Any loss of such data or any theft of such data during transmission shall not be the responsibility of Anvayins or its affiliates.
22. Anvayins and/or its affiliates may send, and You consent to them sending, any details including information relation to bookings, itinerary, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by You. By accepting the terms herein, You shall be deemed to provide Your unconditional consent for this.
23. Anvayins or its agents or affiliates may also contact You inter alia by voice call, SMS, e-mail or any other form of social media for any reason what so ever including to gauge Your preference and to provide any other assistance. By accepting the terms herein, You shall be deemed to provide Your unconditional consent for this.
24. You hereby also authorize Anvayins and/or its affiliates to contact You with offers through e-mails, calls, short messaging services (SMS) or any other mediums for any campaigns, promotional or like activities.
25. You hereby agree that such methods of contact as provided herein do not classify as an “unsolicited commercial communication” as per the guidelines of Telecom Regulation Authority of India (“TRAI”). You agree to indemnify Anvayins, its affiliates, their directors and employees against all types of losses and damages incurred by them due to any action taken by TRAI or any other authority due to any erroneous compliant raised by You in this regard.
26. Anvayins and/or its affiliates may disclose site member information if required to do so by law, court order, as requested by other Government or law enforcement authority, or where disclosure is necessary or advisable.
27. Anvayins and its affiliates may also collect personal information from You to facilitate the delivery of queries, services or the fulfilment of an order, to provide you information and samples You request, to give you a customized interactive experience, and to help Anvayins and/or its affiliates develop and notify You about new products and services that meet Your needs. Anvayins and its affiliates consider such personally identifiable information to be confidential, and their policy is to refrain from disclosing personally identifiable information gathered online to third parties unless release is required or permitted by law or the release is pertinent to judicial or government investigations or proceedings or the release is subsequent to a consent obtained by You. Further Anvayins and its affiliates shall not be responsible for any theft of such personally identifiable information by anyone. In addition, Anvayins and its affiliates may use third parties to fulfill orders or manage websites. In such instances, Anvayins and its affiliates shall provide these companies with the personal information they need to provide such services. Anvayins and its affiliates shall take commercially reasonable measures to require these companies to protect this personal information to the same standard. Anvayins and its affiliates does not use the information for any other purpose other than to complete the transaction. Anvayins and its affiliates may also disclose personal information when they believe in good faith that disclosure is necessary or appropriate to avoid violation of, or interference with, the terms of use of this website or its services, or with their proprietary rights, or the rights of third parties.
28. If a part or the whole of the brand, or some or all of its business or assets are sold to any other entity or if there is any change in the constitution, personal information provided to that brand or business may be transferred to the purchaser or new owner.

Force Majeure

29. Neither Anvayins nor its affiliates nor agents shall not be liable for delays, injuries or inabilities in performance or non-performance in whole or in part of its obligations due to any causes that are not due to its acts or omissions and are beyond its reasonable control (“Force Majeure”), such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism or other similar causes, problems at airlines, rails, buses, hotels or transporters end.
30. You agree and acknowledge that in such Force Majeure circumstances Anvayins, its affiliates, agents and others including the service operators may be unable to honour the services if and where confirmed. Anvayins or its affiliates shall endeavour to provide mutually acceptable alternatives in such instances and/or refund such amounts withholding any reasonable deductions.

Liabilities and Indemnity

31. The maximum liability of Anvayins or its affiliates for any services offered to You whether on the website or otherwise shall be limited to the total amount received from You less any cancellation, or others charges, as may be applicable
32. In no event shall Anvayins and/or its affiliates and/or agents be liable to You for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the services.
33. You agree to indemnify, defend and hold harmless Anvayins and/or its affiliates and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) incurred by Anvayins and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to this Agreement.

Waiver of Liability

34. By engaging the services of Anvayins and/or by making or authorizing a payer to make a payment to Anvayins on your behalf as set forth in an invoice issued by Anvayins, you affirm that the participant(s)/user fully understands and agrees to the following Participant Waiver & Release of Liability (hereinafter collectively referred to as “Waiver Agreement”) and terms & conditions as set forth in this Waiver Agreement.
35. You acknowledge, attest, agree and represent that you are aware that there are inherent risks, dangers and hazards to which you may be exposed while participating in a trip, including but not limited to the following:
36. theft, vandalism or loss of personal property;
37. motor vehicle or traffic accidents;
38. diseases and health emergencies;
39. exposure to wildlife;
40. different environmental and weather conditions and the risks they entail;
41. travel to remote areas wherein the medical facilities may be of a lower standard;
42. hazards resulting from political unrest, military and/or terrorist activity, previous or present;
43. cancellation of this trip or curtailment or cancellation of individual activities due to weather, flooding, illness, political disturbances, terrorism, motor vehicle accidents, transportation problems, failure to perform on the part of local travel guides or other circumstances either within or beyond the control of Anvayins.
44. tour activities have inherent risks, dangers and hazards which include the possibility of personal injury, death, property damage or loss resulting thereof.

Release of Liability, Waiver of Claims and indemnity Agreement

36. In consideration of Anvayins allowing your participation in this trip, you agree as follows:
37. to waive any and all claims that you have or may have in the future against Anvayins and its board of directors, employees, agents, affiliates, volunteers and independent contractors (all of whom are hereinafter collectively referred to as “the Releasees”);
38. to release the Releasees from any and all liability for any loss, damage, injury or expense that you might suffer, or that your next of kin may suffer as a result of your participation in this trip due to any cause whatsoever, including breach of contract, or tortious acts or omissions on the part of the Releasees;
39. to hold harmless and indemnify the Releasees from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from your participation in this trip;
40. This Waiver Agreement shall be effective and binding upon your heirs, next of kin, executors, administrators, assigns and representatives in the event of death or incapacity. In entering into this Waiver Agreement, you are not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this Waiver Agreement.

Participants of Minority Age

37. The parent/guardian with legal responsibility for a participant of minority age, consents and agrees to his/her release of the Releasees, and such parent/guardian and their heirs, assigns, and next of kin, agree to release and to indemnify the Releasees and/or Anvayins for any and all liabilities incidental to this participant of minority age in the tour.

Data and Cookies

38. Anvayins and its affiliates are committed to protecting the confidentiality and security of personal information that You choose to provide.
39. Cookies are small pieces of information that are stored by Your browser on the computer’s hard drive. Cookies are read by the server that placed them. You acknowledge that cookies allow Anvayins and/or its affiliates to serve You better. You consent to Anvayins or its affiliates providing anonymous statistical information to inter alia advertisers and for purposes of market research.
40. You also permit Anvayins or its affiliates to obtain additional data including GPS location and the use of Camera and Microphone which are required in *iOS* to allow photos, and videos, use of session data which includes information about Your computer including IP address, operating system and type of browser software being used and the activities conducted by You.
41. Anvayins and/or its affiliates do not guarantee the safety and security of online payments made by You on or through their website and other mediums. At any point in time, Anvayins and /or its affiliates may refer You to a payment gateway; payment through such gateway shall be entirely at Your risk. You agree to not hold Anvayins and /or its affiliates responsible for any misuse of You credit/debit or other cards, etc. through its medium or through any payment gateways it redirects You to.
42. In the event You access third party links through the website or other mediums of Anvayins or its affiliates, please be advised that Anvayins and/or its affiliates shall not be responsible for any actions or inactions of such third party links.
43. Anvayins and its affiliates are not responsible for the content or privacy practices employed by other sites. Anvayins and its affiliates do not control the privacy policies of other websites. For these reasons, Anvayins and its affiliates encourage You to review the privacy policies of these websites before disclosing any personal information to or through them.

Miscellaneous

44. In case Anvayins or its affiliates have any reason to doubt the veracity during or after receiving a request for services from You, they, in its sole discretion shall have the unrestricted right to take any action legally permissible, against You or in lieu of You and without any prior intimation to You. In such an event, neither Anvayins nor its affiliates nor agents shall be responsible or liable for any loss or damage that may be caused to You including inter alia as a consequence of any cancellation of Your booking or services.
45. You agree to not hold Anvayins and / or its affiliates responsible for any cancellation of performances or shows that are part of the itinerary whether or not with sufficient notice.
46. Neither Anvayins nor its affiliates take responsibility for an impact on any part of the services chosen by You including an impact on forward connections and itinerary due to any delays in the service opted for by You, for any reason.
47. You accept can acknowledge that Anvayins and its affiliates shall not be responsible for providing You any infrastructure facilities, or medical assistance as part of their service offerings. Further, by subscribing to the products / services of Anvayins and/or its affiliates, You accept the risk of poor or zero medical assistance in the locations You travel to through the services of Anvayins and / or its affiliates.
48. Anvayins and/or its affiliates may offer a range of adventure activities as part of their product/service offerings. Participation in such adventure activities shall be wholly at your risk and costs.
49. Neither Anvayins nor its affiliates are responsible for the culture adopted by the local communities including inter alia animal sacrifice or any discomfort, through their partners via whom they provide their product / service offerings.
50. You agree and acknowledge that pictures and videos shown on the mediums of Anvayins and /or its affiliates may be different from the actual visuals or may have been modified and You agree to not hold Anvayins or its affiliates responsible for any of Your actions taken on the basis of such pictures/videos.
51. By accepting these terms herein, You agree and acknowledge that You have read the privacy policy contained herein and further agree that the terms provided are reasonable.
52. If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.
53. None of the provisions of this Agreement shall be deemed to constitute a partnership between You and Anvayins or its affiliates and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way. It is hereby clarified that Anvayins and its affiliates may not be construed to have a principal agency relationship as per the Indian Contract Act, 1872 unless specified otherwise as per any written agreement.
54. If you have questions or concerns regarding your privacy, would like to be removed from Anvayins’ (or it affiliates’) mailing lists or change Your preferences about the information You receive, or would like to delete or amend Your personal information, please contact Anvayins and its affiliates directly. 55. In the event of any dispute in relation to this Agreement, such disputes shall be settled amicably, failing which such disputes shall be referred to a sole arbitrator appointed by Anvayins and shall be resolved as per the provisions of the Arbitration and Conciliation Act, 1996 read with its amendments. The place of arbitration shall be Mumbai and the decision of the sole arbitrator shall be final and binding upon the Parties hereto. The costs of the arbitration shall be borne by You.
56. Anvayins and/or its affiliates hereby expressly disclaim any implied warranties imputed by the laws of any jurisdiction or country other than those where they are operating their offices.
57. This Agreement shall be governed by the laws of India and the courts of Mumbai, India shall have the exclusive jurisdiction

Refund and Cancellation Policy

58. Refunds upon cancellation will depend on the tours or plans selected by a prospective client, and shall be specified in the proforma invoice shared with the said client.

Pricing Policy

59. Currently we are not offering any standard packages.
